Albert L. Celeste, Licensed Public Adjuster ("we," "us," or "our") is committed to protecting the privacy of individuals who visit this website and submit information through it. This Privacy Policy explains what information we collect, how we use it, how we protect it, and your rights with respect to it.

This policy is issued in compliance with the New York Stop Hacks and Improve Electronic Data Security Act (SHIELD Act), as amended through December 2024, and applicable provisions of New York Insurance Law. Please read it carefully.

 

1. Information We Collect

We collect personal information only when you voluntarily provide it through this website. This includes:

  • Contact information — your name, phone number, and email address submitted through the contact form

  • Claim-related information — any description of an insurance claim or property loss you choose to include in a message or inquiry

  • Communications — records of correspondence initiated through this website or by email

 

We do not collect sensitive personal information such as Social Security numbers, financial account numbers, payment card information, or government-issued identification numbers through this website. Any such information required in connection with public adjuster services is collected separately under a signed written agreement and handled in accordance with applicable law.

We do not knowingly collect personal information from individuals under the age of 18. If you believe a minor has submitted information through this site, please contact us immediately.

 

2. How We Use Your Information

We use the information you provide solely for the following purposes:

  • To respond to your inquiry or request for a consultation

  • To evaluate whether we are able to assist with your insurance claim

  • To communicate with you regarding public adjuster services

  • To comply with applicable legal and regulatory obligations

 

We do not sell, rent, lease, or trade your personal information to third parties for marketing or commercial purposes. We do not use your information for any purpose unrelated to the services described on this website.

 

3. Legal Basis and NYS Regulatory Compliance

As a licensed New York State Public Adjuster regulated by the New York State Department of Financial Services (DFS), we are subject to applicable provisions of New York Insurance Law, including New York Insurance Law § 2108, and the data security requirements of the New York SHIELD Act (N.Y. Gen. Bus. Law § 899-aa et seq.), as amended.

The December 2024 amendments to the SHIELD Act expanded the definition of protected private information to include medical information and health insurance information. To the extent any such information is submitted through this website or shared with us in connection with a claim consultation, it is treated as private information subject to the full protections of this policy and applicable law.

 

4. How We Protect Your Information

In accordance with the New York SHIELD Act, we implement reasonable administrative, technical, and physical safeguards to protect the personal information we collect from unauthorized access, use, disclosure, modification, or destruction. These safeguards include:

  • Administrative safeguards — limiting access to personal information to those with a need to know in connection with the provision of public adjuster services

  • Technical safeguards — use of secure electronic communication practices and protection of devices used to store or transmit personal information

  • Physical safeguards — secure storage and appropriate disposal of documents and records containing personal information

 

As a small business under the SHIELD Act, our security program is calibrated to be appropriate to the size and nature of our operations, the sensitivity of the information we hold, and the costs of available security measures, in accordance with the Act's small business provisions.

 

5. Data Breach Notification

In the event of a data breach involving your personal information, we will notify affected individuals and the required New York State agencies — including the Office of the New York State Attorney General, the New York Department of State, the New York State Police, and the New York State Department of Financial Services — within the timeframes required by law. Under the December 2024 SHIELD Act amendments, notification to affected individuals must occur within 30 days of discovery of the breach, subject to any law enforcement exception.

Breach notifications will include a description of the incident, the categories of information involved, the steps we have taken or are taking in response, and information about resources available to affected individuals.

 

6. Sharing of Information

We do not share your personal information with third parties except in the following limited circumstances:

  • Service providers — we may engage third-party service providers (such as website hosting or email services) who process information on our behalf. Such providers are required to maintain the confidentiality and security of your information and may not use it for any purpose other than providing services to us.

  • Legal compliance — we may disclose information when required to do so by law, court order, or regulatory requirement, including disclosures to the New York State Department of Financial Services in connection with our licensed activities.

  • Insurance claim activities — in the course of representing you as your public adjuster, we may share relevant claim information with your insurance company, third-party professionals, or others as necessary to pursue your claim. Any such sharing is governed by the written public adjuster agreement between us.

 

We do not share your information with repair contractors, restoration companies, or other service providers in connection with an insurance claim unless expressly authorized by you and disclosed in the written public adjuster agreement, in accordance with New York Insurance Law § 2108.

 

7. Cookies and Website Analytics

This website may use cookies and similar tracking technologies to support basic website functionality and to understand how visitors use the site. Information submitted through the contact form for which no engagement is established will be retained only as long as necessary to respond to the inquiry and then securely disposed of in accordance with our data security program.

While New York State does not currently have a comprehensive consumer privacy rights statute, we are committed to honoring reasonable requests regarding your personal information. You may:

  • Request confirmation of whether we hold personal information about you

  • Request correction of inaccurate personal information we hold

  • Request deletion of personal information we hold, subject to our legal and regulatory retention obligations

 

To exercise any of these rights, please contact us using the information in Section 12. We will respond to reasonable requests within a reasonable timeframe.

 

11. Children's Privacy

This website is not directed at individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe we have inadvertently collected information from a minor, please contact us and we will take prompt steps to delete it.
